The revised Payment Services Directive had to be transposed into Dutch legislation and regulations on 13 January 2018.
This directive is better known as 'PSD II'. Much has been said and written about PSD II, and not only in legal literature. For example, the FD recently reported that with the approaching implementation deadline, the 'battle' between banks and FinTechs is nearing its climax. Service providers other than banks, such as start-ups, FinTechs and BigTechs such as Alibaba, Amazon, Apple and Google, could become a major threat to traditional banks thanks to PSD II.

The AFM wishes to draw the attention of investment institutions to the Principles of Fund Governance of the Dutch Fund and Asset Management Association (DUFAS).
The code of conduct was published by DUFAS in February 2008 in response to the recommendations made by the Investment Institutions Modernisation Committee (the Winter Committee) at the end of 2004 regarding the way in which these institutions are organised.
The AFM indicates that it will actively monitor fund governance. In this contribution I will discuss the main features of the structure and content of the Code of Conduct.
